- Must I appear in court on the date set forth on my citation?
If you wish to plead not guilty, you may do this by mail without appearing in court on the date set forth on your citation. Mail the plea to the address at the top of the page. Include the charge, the date you were scheduled to appear, the ticket number, your current mailing address and your phone number. This must be received by the date on your citation. A court date for a pretrial conference will be mailed to you. You will have to appear at the pretrial conference.
If you do not contest the citation you may send the deposit amount prior to your court date. If a deposit is posted and you do not appear in court, you will be found guilty, and the deposit money posted will be forfeited.
If you don't deposit money and you also fail to appear in court, a judgement will be entered against you for the amount of the ticket. You will be allowed 60 days to pay. If you do not pay within 60 days you may be committed to jail, or your license will be suspended for failure to pay. There is a $50.00 reinstatement fee after suspension.
- What will happen if I appear in court on the day of my citation?
The date on your citation is the date of your initial appearance. An initial appearance is your opportunity to enter a plea to the charge. You may plead guilty, not guilty or no contest. THE INITIAL APPEARANCE IS NOT THE TRIAL DATE. If you plead guilty or no contest, the court will find you guilty and the matter will be resolved at the initial appearance. If you plead not guilty, your case will be scheduled for a pretrial conference at a later date.
- If I don't want to fight the ticket, can I simply get time to pay?
Yes. If you do not appear in court, the court will enter a judgement against you for the amount of the ticket. You will then be allowed 60 days to pay. - I wish to plead not guilty, how do I do that and what will happen in court?
You may plead not guilty by appearing in court on the date on your citation, or by entering a not guilty plea in writing by mail prior to the court date. mail the written plea of not guilty to the address at the top of this page and include the charge, the date you were scheduled to appear, the ticket number, your current mailing address and phone number. This must be received by the date on your citation. After you plead not guilty, the case will be scheduled for a pretrial conference. You must attend the pretrial conference. If the case is not settled at the pretrial conference, the case will be scheduled for a trial where all parties must appear.
- I'm worried about the points against my driving record. How do I know if I'm in point trouble?
If you are found guilty of a traffic violation, your driving record may be charged with demerit points. The court will not determine the number of points assessed against your driving record. The court will merely report the conviction to the Division of Motor Vehicles and the division will assess the number of points against your record, depending on the charge. The following point schedule lists common traffic violations. Other violations not listed may carry points. If you accumulate 12 points against your driving record within a 12 month period by date of violations, your license will be suspended or revoked.

The Middleton City Council has enacted a number of ordinances which, although not totally unique, may be new to you. The most commonly encountered are the following:
Animal Control All dogs and cats must be restrained by a leash when off the premises of the owner, are not allowed in city parks and convening area. Dogs and cats must be licensed and vaccinated against rabies. A license may be purchased from the City Clerk.
Discharging and Carrying of Firearms Persons other than police officers are prohibited from discharging a firearm within the City. No person under the age of 18 may possess a firearm or ammunition for a firearm unless accompanied by a parent or guardian. The definition of a firearm under this ordinance includes BB guns, pellet guns, etc.
Curfew Minors Under Fifteen. It shall be unlawful for any person under the age of fifteen (15) to be upon the streets or alleys or other public areas in the City between the hours of 10:00 pm and 5:00 am Sunday through Thursday and between the hours of 11:00 pm and 5:00 am Friday and Saturday, unless accompanied by a parent or legal guadian.
Minors Over Fifteen and Under Eighteen. It shall be unlawful for any person fifteen (15) years of age and over and under the age of eighteen (18) years to be upon the streets or alleys or other public areas in the City between the hours of 11:00 pm and 5:00 am Sunday through Thursday and between the hours of 12:00 am (midnight) and 5:00 am Friday and Saturday unless accompanied by a parent or legal guardian.
The provisions of this subsection not apply if:
1. The minor is going home from a school sponsored activity when the activity ends after the applicable curfew, or
2. The minor is going to or returning from their place of employment.
No parent or legal guardian shall knowingly permit their child or ward to be on the streets, alleys or other public areas in the City of Middleton in violation of these subsections.

Bicycle Registration If you own a bicycle, it must be registered with the Police Department. The fee is $2.00 for a lifetime registration. All bicycles operated on the streets must be maintained in a safe operating condition.
Snow and Ice Removal
City Ordinance says that the owner, occupant or person in charge of each building, structure or unoccupied lot in the City fronting or abutting a street shall remove snow and ice from the sidewalk, including handicap ramps (the ramps between the sidewalk and the street) as well as from any fire hydrant adjacent to such building, structure or unoccupied lot. The snow and/or ice must be removed from the entire width of the sidewalk and handicap ramps and from fire hydrants within 24 hours following the end of the snowfall. If ice cannot be removed immediately, it shall be sprinkled with salt, sand or combination thereof until it can be removed. Snow shall be removed from fire hydrants to a point no higher than four (4) inches below the lowest outlet. No person may deposit snow or ice from private property or sidewalks, upon the sidewalk, roadway or street, or cause or order the same to be done.
On Street Parking Vehicles or trailers cannot be parked on a public street for longer than 24 hours. For your own protection and the safe movement of traffic, we urge you to use off street parking whenever possible. Wisconsin law prohibits parking "against traffic" on all streets and highways.
There is at least one officer assigned to each of the 3 patrol districts 24 hours a day. To contact officer assigned to your district contact the police department dispatcher at 827-1000.
To help facilitate the removal of ice and snow from city streets during the winter months, the City has adopted seasonal parking ordinances. If it is necessary for you to leave a vehicle on the street between 1:00 AM and 7:00 AM from November 15 to March 15 of each year, park it on the even numbered side of the street on even numbered calendar days and likewise, park on the odd numbered side on odd numbered calendar days. To help ensure compliance, this ordinance is regularly enforced throughout the season.

Copies of police reports may be available from our Records Department during normal business hours, 7:45 am to 4:30 pm , Monday through Friday. Incidents assigned for follow up investigation, or when citations have been issued or charges have been referred to the District Attorney’s Office may not be available until a later time. Inquiries may be made via phone to the Records Department, 608-827-1009, or via email, policerecords@ci.middleton.wi.us. There is a charge of 25 cents per page for printed reports, and no charge for emailed reports.
